Propositionens huvudsakliga innehåll

Den internationella järnvägstrafiken regleras av det järnvägsfördrag som brukar benämnas COTIF. Fördraget förvaltas och utvecklas av OTIF, den mellanstatliga organisationen för internationell järnvägstrafik.

Vid OTIF:s generalförsamling i september 2018 beslutades vissa ändringar i fördraget. Ändringarna blir bindande för medlemsstaterna, däribland Sverige, om ett tillräckligt antal stater godkänner dem. Den huvudsakliga ändringen består i antagandet av ett nytt bihang till fördraget om säkerhetskrav för internationell järnvägstrafik. Dessutom ändras reg- lerna om när framtida ändringar i bihangen ska träda i kraft. I övrigt är det huvudsakligen fråga om följdändringar med anledning av det nya bihanget och vissa förtydliganden.

I propositionen föreslår regeringen att Sverige ska godkänna ändring- arna och att dessa, i den utsträckning som det behövs, ska införlivas med svensk rätt i berörda lagar om järnvägstrafik. Det föreslås också vissa rättelser i järnvägstekniklagen.

Lagändringarna föreslås träda i kraft den dag som regeringen bestäm- mer. Rättelserna i järnvägstekniklagen föreslås dock träda i kraft den 1 januari 2025.

Regeringens förslag:

1. Riksdagen godkänner de av generalförsamlingen vid OTIF den 25–26 september 2018 beslutade ändringarna i fördraget om internationell järnvägstrafik (COTIF) av den 9 maj 1980 i dess lydelse enligt ändringsprotokollet av den 3 juni 1999.

2. Riksdagen godkänner de av generalförsamlingen vid OTIF den 25–26 september 2018 beslutade ändringarna i bihang E till fördraget.

3. Riksdagen godkänner de av generalförsamlingen vid OTIF den 25–26 september 2018 beslutade ändringarna i bihang G till fördraget.

Härigenom föreskrivs att bilagan till järnvägstrafiklagen (2018:181) ska ha följande lydelse.
